Burk graduated from The University of Virginia in 1977 with a BA in Government and Psychology and received his Juris Doctorate from Washington and Lee University School of Law in 1980. Given an "AV" with Martindale Hubbell, four of his appellate cases have been cited as the leading criminal case for the year at seminars in Virginia, including Zimmerman v. Commonwealth , Va. App. ____ which led all drug courier profile cases in Virginia; Basfield v. Commonwealth , Va. App.____, which held all lab results must follow the same guidelines for admissibility for driving under the influence cases as were required for drug cases; Taylor v. Commonwealth ,VA. App.____ which held that the Virginia Model Jury instruction was inaccurate in its description for breath testing in DUI cases; and Lash v. Commonwealth , Va. App.____ which held that the same act cannot be punished by two separate statutory charges unless they are prosecuted in one proceeding.
